These terms govern your use of sootheka.com and, once our store opens, any purchase you make from us. By using this website you agree to them. If you do not agree, please do not use the site.

sootheKA is a skincare brand operated by The KA Collective Limited, a company registered in Auckland, New Zealand.

Using this website
You may browse this website and join the waitlist for personal, non-commercial use. You agree not to misuse the site — including attempting to access it by means other than the interface we provide, interfering with its normal operation, or copying, scraping, or reverse-engineering its content or code without our permission.
We aim to keep the information on this site accurate and current, particularly on ingredients and formulation, and we correct errors when we find them. We do not guarantee the site will be uninterrupted or error-free.

The waitlist and pre-launch status
sootheKA has not yet opened for sale. Joining the waitlist is not an order, a reservation, or a commitment on either side — it simply asks us to notify you when the store opens. Pricing, formulas, and availability described on this site may change before launch.

Purchases, once the store opens
When sootheKA begins taking orders, the following will apply to them:
- All prices are in New Zealand dollars (NZD) and, where GST applies, GST-inclusive.
- Payment is processed securely by Stripe; we do not store your full card details ourselves.
- An order is an offer to buy. We may decline or cancel an order — for example if an item is unexpectedly unavailable, if a price was displayed incorrectly, or on reasonable suspicion of fraud — and will let you know if we do.
- Your order is accepted, and a contract formed, when we confirm dispatch.

Delivery, returns and refunds

Nothing in these terms limits any right or remedy you have under the New Zealand Consumer Guarantees Act 1993 that cannot lawfully be excluded.

Product use
sootheKA products are cosmetic skincare. They are not medicines or medical devices, have not been assessed by a medical authority, and make no claim to diagnose, prevent, or have any effect on a medical condition.
Patch-test a new product before regular use. If irritation, redness, or discomfort occurs, stop using the product and, if it persists, see a doctor or dermatologist. Ingredient lists for each product are published in full on its product page.

Intellectual property
The sootheKA name, logo, and the content of this website — text, photography, and design — belong to The KA Collective Limited or its licensors. You may not reproduce, distribute, or create derivative works from them without our written permission.

Limitation of liability
To the extent permitted by law, and subject to section 05 above, our liability to you in connection with this website or a purchase is limited to the value of the relevant order. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, including under the Fair Trading Act 1986.

Changes to these terms
We may update these terms from time to time, particularly as we move from waitlist to full commerce. When we make a material change, we will update the “Effective” date at the top of this page. Continued use of the site after a change is posted means you accept the updated terms.

Governing law
These terms are governed by the laws of New Zealand, and any dispute arising from them is subject to the exclusive jurisdiction of the New Zealand courts.
